We aim to establish a stimulating art gallery, dedicated to showcasing the works of both the renowned and the unknown, the alluring and the absurd – a lively fusion of fine art, culture and uniqueness.

Art often appears “useless” in a utilitarian world. A painting doesn’t plow a field, a poem doesn’t feed you, a piece of music doesn’t build a bridge. Yet the so-called “useless” things give depth, beauty, meaning, and healing – things far more essential than we tend to admit. In that sense, art’s “uselessness” is its most useful quality. It nourishes the soul; it keeps us human. Thus, we are not just curating things that are “beautiful decorations”, nor are we treating art as an “investment commodity.”

Art is not meant to be justified by function. The “useful” loses its purpose if not infused with the seemingly “useless” dimensions of creativity, play, and spirit. We are not just showing beautiful art but invite you also to risk taking a small disruptive step into the absurd, to see the “useless” as essential, and to feel how art gives purpose to the merely useful. GALLERY jENSEITS strives to provide a joyful, unbiased, contemplative and communal space, for collectors, artists, and all who seek inspiration, offering a nurturing environment for experiencing what contemporary art has to offer.

These Sales Terms & Conditions apply to all purchases of artwork and related items from GALLERY JENSEITS LLC, including paintings, drawings, framed and unframed prints, limited-edition prints, sculptures, objects, mixed-media works, and other works of art.

1. Final Sale / No Returns

All artwork sales are final. We do not accept returns, exchanges, or cancellations after purchase, except where required by applicable law or where GALLERY JENSEITS LLC agrees otherwise in writing.

Because original artworks, limited-edition prints, framed works, and sculptures are unique or specially handled items, buyers are encouraged to inspect the artwork carefully before purchase and to ask any questions before completing the sale.

2. Condition of Artwork

All artwork is sold in its present condition at the time of sale. Minor variations, age marks, surface irregularities, texture, framing imperfections, artist-made marks, or material characteristics may be part of the nature and character of the artwork and are not defects.

For framed works, the frame, glass, acrylic, matting, or mounting may be included as part of the sale unless otherwise stated. Frames are generally sold “as is” unless specifically described otherwise in writing.

3. Prices, Taxes, and Payment

All prices are stated in U.S. dollars. Applicable Ohio and local sales taxes will be added where required by law.

Payment must be made in full before artwork is released, delivered, shipped, or transferred to the buyer, unless GALLERY JENSEITS LLC agrees otherwise in writing.

For purchases paid by credit card, a credit card processing surcharge of 3% will be added to the sales price, subject to applicable law and card-network rules. This surcharge does not apply to payments made by cash, check, ACH, debit card, or other non-credit-card payment methods.

Payment must be made in full before artwork is released, delivered, shipped, or transferred to the buyer, unless GALLERY JENSEITS LLC agrees otherwise in writing.

4. Reservations and Holds

Artwork may be reserved only with written confirmation from the Gallery. A hold, reservation, or verbal expression of interest does not create a completed sale unless payment terms and confirmation have been agreed to in writing.

The Gallery may decline or cancel a reservation if payment is not received within the agreed time.

5. Pickup, Delivery, and Shipping

Artwork may be picked up, delivered, or shipped as agreed between the buyer and the Gallery.

Unless otherwise agreed in writing, the buyer is responsible for delivery, shipping, insurance, packing, crating, and related handling costs. Risk of loss or damage passes to the buyer once the artwork is picked up by the buyer, delivered to the buyer, or transferred to a carrier, shipper, courier, or third-party delivery service.

The Gallery will make reasonable efforts to assist with safe packing and shipping arrangements but is not responsible for delays, loss, or damage caused by third-party carriers or handlers.

6. Limited-Edition Prints

Limited-edition prints may include an edition number, certificate of authenticity, gallery embossing, artist signature, or other documentation, depending on the specific work and edition.

Edition details, paper type, print size, image size, artist signature, certificate, and framing status will be described as accurately as possible at the time of sale. Slight variations in color, paper texture, margins, or presentation may occur and are not considered defects.

7. Authenticity and Attribution

The Gallery makes reasonable efforts to describe artworks accurately, including artist name, title, medium, dimensions, edition information, and known provenance.

Unless expressly stated in a separate written certificate or invoice, descriptions, artist statements, exhibition texts, and related materials are not independent appraisals, guarantees of future value, or investment representations.

8. Copyright and Reproduction Rights

Purchase of artwork does not transfer copyright, reproduction rights, licensing rights, or other intellectual property rights unless expressly agreed in writing.

The buyer may not reproduce, publish, sell reproductions of, license, commercially display, or otherwise exploit images of the artwork without written permission from the copyright holder, except as permitted by law.

The Gallery and/or artist may retain the right to use images of the artwork for archival, promotional, educational, publication, website, social media, and exhibition-related purposes, unless otherwise agreed in writing.

9. Installation and Display

The buyer is responsible for proper installation, hanging, display, storage, lighting, care, and maintenance after the artwork has been released to the buyer or the buyer’s representative.

The Gallery is not responsible for damage caused by improper handling, framing, installation, humidity, sunlight, heat, cleaning, storage, or environmental conditions after transfer.

10. No Investment Guarantee

Artwork is purchased for personal, aesthetic, cultural, or collecting purposes. The Gallery does not guarantee resale value, appreciation, future marketability, or investment performance.

11. Special Orders, Commissions, and Custom Framing

Special orders, commissioned works, custom framing, special printing, and other customized items are final sale and may require a deposit or full payment in advance.

Deposits for commissions, custom work, or special orders are non-refundable unless otherwise agreed in writing or required by law.

12. Off-Site Sales

For sales completed away from the Gallery’s regular place of business, certain federal or Ohio cancellation rights may apply. The FTC Cooling-Off Rule generally gives consumers three business days to cancel certain sales made at a buyer’s home, workplace, dormitory, or a seller’s temporary location, but it does not usually apply to ordinary purchases made at the seller’s regular place of business.

13. Governing Law

These Sales Terms & Conditions are governed by the laws of the State of Ohio and applicable federal law. Any dispute shall be handled in accordance with Ohio law, unless a different jurisdiction is required by applicable law.

14. Entire Agreement

The invoice, receipt, certificate of authenticity if any, and these Sales Terms & Conditions together form the agreement between the buyer and GALLERY JENSEITS LLC for the purchase of the artwork. Any changes must be in writing and approved by the Gallery.
